Federal Appeals Court Blocks Biden Admin Effort to Remove Razor Wire From Tex-Mex Border

On Wednesday, a federal appeals court blocked the Biden administration’s attempt to remove razor wire installed by Texas officials along the Mexico border.

State authorities initiated the lawsuit last year after the administration directed Border Patrol agents to dismantle the wired fencing in Eagle Pass. The wire was part of Governor Greg Abbott’s border security initiative, Operation Lone Star.

The Biden administration asserted that it was protected by sovereign immunity and later argued that the razor wire had hindered federal efforts to rescue two illegal immigrants who drowned earlier this year during the appeals process. However, Texas has contested the administration’s claim, arguing that the fencing did not impede the rescue operations, according to CNN.

The 5th Circuit Court of Appeals rejected the administration’s arguments on sovereign immunity on Wednesday, and agreed with a lower court’s ruling that the state’s actions “had only a marginal effect on Border Patrol’s access and had nothing to do with the drownings.”

The ruling was issued in a 2-1 vote, with Judge Irma Carrillo Ramirez, who was appointed by President Joe Biden, dissenting.

Meanwhile, former Immigration and Customs Enforcement official-turned ‘border czar’ Tom Homan said during an interview Tuesday he will have no problems jailing Democratic officials in cities and states around the country who try to interfere with the incoming administration’s pledge to mass deport people in the country illegally.

Homan, during a segment on Sean Hannity’s Fox News program, was responding to a vow by Denver Mayor Mike Johnston to impede federal immigration authorities who sought to locate and deport anyone in the U.S. illegally who was posing the biggest threats to public safety.

“Tom, you heard this mayor out there in Colorado, I want to get your reaction to it. And I want you to be clear about who has jurisdiction. The federal government or state and local governments? And if you’re a sanctuary state or city, are you breaking the law?” Hannity asked.

Homan responded: “Yeah, you’re absolutely breaking the law. All he has to do is look at Arizona vs. U.S. and you will see he’s breaking the law.”

“But look, me and the Denver mayor we agree on one thing. He’s willing to go to jail. I’m willing to put him in jail. There’s a statute, Title 8, United States Code 1324 – AAA. And what it says is it’s a felony if you knowingly harbor and conceal illegal aliens from immigration authorities. It is also a felony to impede a federal law enforcement officer,” Homan continued.

“So if you don’t want to help, that’s fine. He can get the hell out of the way, but we’re going to go do the job. President Trump has a mandate from the American people. We’ve got to secure this country and save American lives,” he added.
