Supreme Court Justice Sonia Sotomayor has responded to calls from Democrats for her to resign so that she can be replaced by President Joe Biden before President-elect Trump is inaugurated.
“This is no time to lose her important voice on the court. She just turned 70 and takes better care of herself than anyone I know,” a person close to the 70-year-old liberal Supreme Court Justice said, The Wall Street Journal reported.
The news shows that she has no plans on retiring, which is likely to be a crushing blow to the Democrats who have been pestering her to step aside.
University of California, Berkeley, School of Law dean Erwin Chemerinsk, who was one of the first people to say that the late Justice Ruth Bader Ginsburg should retire said that the conditions are not the same this time.
“It is far more uncertain that the Democrats could confirm a successor than in summer 2014,” he said. “And Sotomayor is 70,” as opposed to the late Justice who was 81-years-old when he made his suggestion.
But others were not of the same belief.
“Sotomayor should retire tomorrow and let the lame duck Senate confirm her replacement,” University of Pittsburgh assistant professor of health policy and management Miranda Yaver said on election night on X, formerly Twitter.
“This would probably be a good day for Sotomayor to retire,” said.
“Why take the risk? You have a Democratic president and a Democratic Senate, and you have a justice who is about to turn 70,” former MSNBC host Mehdi Hasan said on CNN.
“It has been possible, historically, to go 12 or 14 years without simultaneous control of the White House and the Senate, after initially losing that control. She could be well into her 80s by the next time she has a good opportunity to retire,” liberal journalist Josh Barro who pens the ‘Very Serious’ newsletter said to the Washington Post.
CNN analyst Bakari Sellers may have had the most insane idea of anyone when he suggested that Justice Sotomayor be replaced by Vice President Harris.
“You have a hell of a vice president right there who has a legal pedigree to sit on a Supreme Court,” he said on Friday. “And let Republicans go crazy, ape, I’m even mentioning that option.”
