Illegal Immigrant Teen Avoids Jail In Fatal Colorado Crash That Killed Young Woman

A 15-year-old illegal immigrant from Colombia who killed a Colorado woman during a high-speed crash will serve no jail time after striking a plea deal with prosecutors in Arapahoe County.

Kaitlyn Weaver, 24, was killed in July 2024 when the teen suspect, driving a Jeep at around 90 mph in a residential neighborhood in Aurora, T-boned her vehicle at an intersection. Weaver was waiting at a stop sign and talking to her boyfriend on speakerphone when the crash happened, according to her father, John Weaver.

“It was an instantaneous death,” he said, according to Fox News.

The teen, whose name is withheld due to Colorado laws protecting the identities of juvenile suspects, was initially charged with vehicular homicide. John Weaver said his family was told by the district attorney’s office early in the process that it was a “no plea offer” case.

However, the office of District Attorney Amy Padden later reversed course. In January, Padden’s office presented a plea agreement that allowed the teen to avoid incarceration in exchange for admitting guilt. He was ultimately sentenced to two years’ probation and 100 hours of community service.

“They said by doing two years’ probation, that’s probably more than the judge would give if he pleaded guilty,” John Weaver said. “You don’t have to participate in a bad system. If the judge wanted to sentence him to less, that’s the judge’s issue. What happened in this case is you (prosecutors) created it into your issue. Now you’re part of the problem.”

Weaver remained on life support for two days before her organs were donated. Her father and the family’s attorney have publicly criticized the plea deal. Attorney Matthew Durkin called the outcome “abhorrent.”

John Weaver also pointed out that the teen was in the country illegally and had no driver’s license at the time of the crash. “We had a collision where the immigration system and the criminal justice system collided, and now my daughter’s dead,” he said.

The Jeep used in the crash was reportedly taken without permission from the teen’s mother. She told authorities she planned to send him back to Colombia, though he has since filed for asylum.

District Attorney Padden has received endorsements from prominent Democrats including Sen. Bernie Sanders and Colorado Gov. Jared Polis. Assistant DA Ryan Brackley issued a statement on the case, saying he “unequivocally” condemns the teen’s actions.

“We believe the conviction to the highest charge in this case and the negotiated sentence acknowledges the seriousness of this preventable tragedy, and that no legal outcome can truly make up for the profound loss and void Kaitlyn’s loved ones will live with permanently,” Brackley said.

In a Facebook post, Padden also addressed the tragedy, writing, “We acknowledge Kaitlyn Weaver’s death was the direct result of a crash caused by an unlicensed teenager driving at nearly twice the posted speed limit. This tragic loss is a powerful reminder that it is not just alcohol or drug-impaired driving that takes lives. Driving at dangerous speeds has deadly consequences too, and they are felt by our entire community.”
