A 16-year-old illegal immigrant from Colombia, who was sentenced to probation and community service after causing the death of 24-year-old Kaitlyn Weaver in a high-speed crash in Aurora, Colorado, was taken into custody by federal immigration agents last week.
U.S. Immigration and Customs Enforcement (ICE) confirmed Thursday that the teen was arrested along with members of his family, who are also in the country illegally. The fatal crash occurred last July when the Colombian teen, driving at approximately 90 mph through a residential area, collided with Weaver’s vehicle.
According to authorities, Weaver was on her way home from work and speaking to her boyfriend on speakerphone when the crash occurred. She was “effectively killed instantly,” her father, John Weaver, said.
ICE’s Denver field office criticized the Arapahoe District Attorney’s Office for not prosecuting the illegal immigrant.
“For the @DA18th justice is no jail time and probation for this criminal alien who killed a young woman while driving more than 90mph. For ICE, justice is arrest and removal,” ICE Denver wrote on X. “A 16-year-old citizen of Colombia, with a conviction for reckless driving resulting in death was arrested by ICE Denver officers last week and will remain in ICE custody pending an immigration hearing.”
In addition to living in the United States illegally, the teen was unlawfully driving his mother’s uninsured vehicle, which she claimed he took without her permission. At the time of the crash, he also had other minors in the car with him when he collided with Weaver’s vehicle.
John Weaver said the district attorney’s office had initially assured his family that it would seek the maximum sentence for the teenager—two years in a correctional facility. However, after Democrat Amy Padden took over as district attorney, the teen was offered a plea deal of two years’ probation in exchange for a guilty plea.
Arapahoe County Assistant District Attorney Ryan Brackley defended the agreement, stating that it was handled by an experienced prosecutor and was not influenced by the change in leadership. Brackley added that the judge upheld the plea deal after hearing statements from the Weaver family, the Daily Wire reported.
