Grand Jury Reindicts Trump Following New Charges From Jack Smith

A federal grand jury in Washington, D.C., has reindicted Donald Trump on four felony charges related to his alleged efforts to overturn the 2020 presidential election results.
The 36-page indictment, filed by Special Counsel Jack Smith on Tuesday, addresses adjustments in the case following the Supreme Court’s recent ruling that grants broad immunity to presidents for actions taken during their official duties.
Despite these changes, the superseding indictment still charges Trump with the same four crimes, including conspiracy to defraud the United States. This suggests that Smith believes the Supreme Court’s ruling will not significantly hinder the prosecution’s case against Trump.
The revised indictment appears to de-emphasize the connection between Trump’s actions and his official duties, focusing instead on the political and personal nature of his conduct after the election and on January 6, 2021.
The re-indictment highlights that Mike Pence, then-Vice President, was Trump’s running mate during the period Trump pressured him to interfere with the election certification. It also notes that the January 6, 2021, rally was privately funded and organized and underscores Trump’s frequent use of his Twitter account for personal purposes.
The updated indictment notably excludes references to several high-ranking officials who had previously informed Trump that his claims of election fraud were unfounded. These changes reflect an effort to align with the Supreme Court’s guidance on prosecuting a sitting president for actions related to their official duties.
The re-indictment also removes any reference to former Justice Department official Jeffrey Clark, who was previously identified as an alleged co-conspirator. Clark was involved in discussions about sending letters to local election officials claiming fraud in the 2020 election, but Trump ultimately dropped the plan after facing strong objections from senior Justice Department officials.
Earlier this month, Smith submitted a new filing in the so-called “election interference” case against Trump with the D.C. Circuit Court. In the filing before U.S. District Judge Tanya Chutkan, Smith requested a delay in the case, noting that his team needed time to review a recent U.S. Supreme Court ruling that appeared to favor Trump.
Critics of the new indictment, which comes days before early voting begins in some states, have accused Smith and the Biden-Harris Justice Department of violating a longstanding policy of holding off on such actions so close to an election.
