Another Blue State Removes Trump From ’24 Ballot For Non-Existent ‘Insurrection’

An Illinois judge declared late Wednesday that former President Donald Trump has been disqualified from appearing on the state’s 2024 Republican presidential primary ballot due to his purported involvement in the January 6, 2021, Capitol riot.

The ruling was handed down by a Chicago-area judge, Trace Porter, who banned Trump from appearing on the ballot a month after the Illinois State Board of Elections refused to do so.

According to court documents seen by Fox News, Porter issued her order on Wednesday while also urging the state board to remove Trump or “cause any votes cast for him to be suppressed” for allegedly violating section three of the 14th Amendment, or the “disqualification clause,” which addresses “insurrection.”

Trump hasn’t been charged with insurrection, much less convicted of it. Currently, the U.S. Supreme Court is considering a case involving the Colorado Supreme Court’s decision to remove Trump from that state’s ballot.

“Porter’s ruling reverses last month’s decision by the Illinois Board of Elections to keep Trump’s name on the primary ballot after a group of Illinois voters accused the former president of engaging in insurrection,” Fox News reported.

That said, Porter stayed her order, giving Trump’s team a short time to appeal. Attorneys for the former president must file by Friday to the Illinois Appellate Court or the Illinois Supreme Court.

A spokesperson for Trump’s campaign told Fox News Porter’s decision “is an unconstitutional ruling that we will quickly appeal.”

The 14th Amendment, Section 3 of the Constitution states, “No person shall… hold any office… under the United States… who, having previously taken an oath, as a member of Congress, or as an officer of the United States… to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.”

A few hundred of the tens of thousands of supporters who came to D.C. to hear Trump’s “Stop the Steal” speech battled with police and breached the U.S. Capitol Building. Trump advised the crowd to “march peacefully” to the Capitol ahead of Congress’ certification of the 2020 election for Joe Biden.
